dc.description.abstractTeknolojinin her geçen gün gelişmesiyle birlikte iş kazası sayıları gün geçtikçe artmaktadır. Bu nedenle iş kazası sayılması gereken olaylar belirlenmelidir. Bu kapsamda belirtmek gerekir ki, sosyal güvenlik hukukundaki kaza kavramı ile bireysel iş hukukundaki kaza kavramı birbirinden farklıdır. Bireysel iş hukukuna göre iş kazası olarak adlandırılan her kaza aynı zamanda sosyal güvenlik hukuku anlamında da bir iş kazası olarak nitelendirilirken, sosyal güvenlik hukukundaki "kaza" kavramı bireysel iş hukuku bakımından bir "iş kazası" teşkil etmeyebilir. Bu nedenle, sigortalıların meydana gelen kaza sonucu sağlanan sosyal yardım ve haklardan etkili biçimde faydalanabilmeleri için iş kazası kavramının doğru anlaşılması ve sigortalının 5510 sK. m. 13/ f. 1 hükmünde sayılan hallerden birisine girecek şekilde kazaya uğraması gerekir. Bu çalışmada iş kazası kavramının daha iyi anlaşılabilmesi için sosyal güvenlik hukuku anlamındaki iş kazası kavramı ve iş kazası sayılan haller tek tek incelenmiştir. Bunun yanı sıra iş kazası sigorta kolunun ilk olarak Almanya'da ortaya çıkması nedeniyle Alman Sosyal Güvenlik Kanunu'nun yedinci kitabının sekizinci maddesinde yer alan iş kazası kavramı ve iş kazası olarak kabul edilen durumlar da ele alınmıştır. Çalışma; giriş, iki ana bölüm ve sonuç olmak üzere toplam dört bölümden oluşmaktadır. Çalışmanın amacı, Türk ve Alman hukukundaki düzenlemelere karşılaştırmalı olarak yer vererek iş kazası olarak kabul edilen durumları tek tek açıklayıp iş kazası kavramının doğru biçimde anlaşılmasını sağlamaya çalışmaktır. Çalışmanın ilk bölümünde Türk sosyal güvenlik hukukundaki iş kazası kavramının tanımı, unsurları ve kanunda iş kazası olarak düzenlenen hâller ele alınmıştır. Çalışmanın ikinci bölümde Alman sosyal güvenlik hukukundaki iş kazası kavramının tanımı, unsurları ve ilgili düzenlemeye göre iş kazası olarak nitelendirilen hâller, konuyla ilgili yargı kararlarına da değinilerek incelenmiştir. Çalışmanın son bölümde ise Türk ve Alman sosyal güvenlik hukukunda iş kazası sayılan hâller karşılaştırmalı biçimde ele alınarak, iki üke düzenlemesinin benzerlikleri ve farklılıkları ortaya konulmaya çalışılmıştır.
dc.description.abstractEspecially with the new developments in technology, the increasing number of occupational accidents requires the definition of which situations may be considered as occupational accidents. In this context, it is important to distinguish between the concepts of "accident" in the area of social security law and individual labour law. At this stage, it should be noted immediately that, while every accident that is called as an occupational accident according to individual labour law, constitutes an occupational accident in terms of social security law as well; not every accident within the area of social security law may constitute an occupational accident in terms of individual labour law. Therefore, in order for the insured to effectively benefit from the social benefits and rights provided as a result of the accident, the concept of work accident must be understood correctly and the insured must be injured in one of the cases listed in Article 13/ paragraph 1 of the Turkish Code of Social Security numbered 5510. Due to the importance of the subject, in this study, the term of occupational accident in the meaning of social security law and the situations considered as occupational accidents are analysed. In addition to this, considering the fact that the occupational accident insurance branch first emerged in Germany, the concept of occupational accident in the eighth article of the seventh book of the Code of German Social Security and the situations that are accepted as occupational accidents are also discussed. The study titled "The Concept of Occupational Accident in Turkish and German Social Security Law" consists of four parts in total: Introduction, two main chapters and conclusion. The aim of the study is to provide the most accurate understanding of the term of occupational accident by explaining the situations that are accepted as occupational accidents in accordance with the legislation of the relevant country one by one. For this reason, the study also includes relevant judicial decisions. In the first part of the study, the definition of the concept of occupational accident in Turkish social security law, its elements and the situations regulated as occupational accidents in the law are explained. In the second part, the definition of the concept of occupational accident in German social security law, its elements and the situations that are considered as occupational accidents according to the relevant regulation are explained by including related court decisions in the relevant sections. In the last part, the situations considered as occupational accidents in Turkish and German social security law are compared and the similarities and differences between the two countries' regulations are observed.
