dc.description.abstract6502 sayılı Tüketicinin Korunması Hakkında Kanun’da tüketici ve tüketici işlemi tanımlarının yeniden yapılması ve eski Kanun’da bulunmayan, tüketiciye yönelik uygulamaların da kapsama dâhil edilmesi ile birlikte Kanun kapsamı oldukça genişlemiştir. Bu durum uygulamada bazı sorunlara sebebiyet vermiştir. Bu sorunlardan biri de tacirin tüketici sayılıp sayılamayacağı ve eğer sayılacaksa hangi durumlarda tüketici olarak nitelendirileceği sorunudur. Zira bir yanda Türk Ticaret Kanunu’nda tanımlanan ticari iş ve ticari iş karinesi ile öbür tarafta Tüketicinin Korunması Hakkında Kanun’da bütün gerçek ve tüzel kişileri kapsayacak şekilde yapılan tüketici tanımı birbiriyle çelişen iki hüküm olarak karşımıza çıkmaktadır. Bu çalışmada bu soruna çözüm aranmıştır
dc.description.abstractThe scope of the Law has expanded considerably with the re-definition of consumer and consumer transactions in the Protection of the Consumer Law No. 6502 and the inclusion of consumer-oriented applications not included in the old Law. This situation caused some problems in practice. One of these problems is whether the trader can be a consumer and if so, in what circumstances. Because, on the one hand, the presumption of commercial business and commercial business accepted in the Turkish Commercial Code and on the other hand, the definition of consumer made to cover all real and juristic persons in the Protection of the Consumer Law appear as two contradictory provisions. In this study, solutions to these problem were sought.
