| dc.description.abstract | In this study, the contracts regarding the transfer of shares of the estate are examined in terms of the relevant subject within the framework of Art. 677- 678 TCC. Whereas in Art. 677 TCC contracts regarding the transfer of shares of the estate concluded after the commencement of the succession are regulated differently depending on whether the transferee is another heir, in Art. 678 TCC such a distinction isn't foreseen for the contracts which are concluded before the commencement of the succession. The aim of the study is to shed light onto the subject relevant provisions of these contracts within the framework of the distinctions observed by the legislator in the regulation thereof. In addition, the approach accepted by the legislator in Art. 677/I TCC which allows that the contracts between the heirs can be made on a part of the estate is examined and it is discussed whether the same approach can be extended to the transfer of shares of the estate to third parties. | |
| dc.description.abstract | Bu çalışmada, TMK m. 677-678 hükümleri çerçevesinde miras payının devrine yönelik sözleşmeler konu unsuru bakımından incelenmektedir. TMK m. 677 hükmünde, mirasın açılmasından sonra miras payının devrine ilişkin sözleşmeler devralanın başka bir mirasçı olup olmadığına göre farklı düzenlenmiş; TMK m. 678 hükmünde ise mirasın açılmasından önce yapılan sözleşmelerde bu tarz bir ayrım gözetilmemiştir. Çalışmanın amacı, kanun koyucunun miras payının devrine yönelik sözleşmeleri düzenlerken gözettiği ayrımlar çerçevesinde bu sözleşmelerin konusunu ve konuyla bağlantılı hükümlerini aydınlatmaktır. Ayrıca mirasçılar arasında miras payının devrine ilişkin TMK m. 677/I hükmünde terekenin bir kısmı üzerinde sözleşme yapılabileceğinin kabul edilmesi ele alınmakta ve bu yaklaşımın TMK m. 677/II hükmü bağlamında üçüncü kişiye yapılan miras payı devirlerine de genişletilip genişletilemeyeceği tartışılmaktadır. | |
