dc.description.abstractSpecial arbitration boards have been established in Türkiye, as in the rest of the world, to resolve sports law disputes in a short time and in an effective manner in accordance with the structure of sports. The Turkish Football Federation became autonomous in 1991, and an Arbitration Board was established within. Subsequently, the Arbitration Board of the General Directorate of Sports was established for other federations that became autonomous. This study will address the grounds for resorting to arbitration in sports law and indicate the new developments in this field for lawyers. Then, it describes the leading institutions of sports arbitration in light of current developments. In this context, the following arbitral institutions will be examined: the Court of Arbitration for Sport (CAS), the Dispute Resolution Board and the Arbitration Board within the Turkish Football Federation, the Arbitration Board of the General Directorate of Sports Law, and the Basketball Arbitral Tribunal (BAT). The topic will be discussed considering the decisions of the European Court of Human Rights (ECtHR) and the Turkish Constitutional Court (CC) to reveal the link between sports arbitration and the right to a fair trial.
dc.description.abstractSpor hukukundan doğan uyuşmazlıkların, sporun yapısına uygun, kısa sürede ve etkin biçimde çözümlenmesi için tüm dünyada olduğu gibi, Türkiye’de de özel tahkim kurulları oluşturulmuştur. Türkiye Futbol Federasyonu 1991 yılında özerk yapıya kavuşmuş ve bünyesinde Tahkim Kurulu oluşturulmuştur. Ardından özerkleşen diğer federasyonlar için Spor Genel Müdürlüğü Tahkim Kurulu oluşturulmuştur. Bu çalışmada spor hukukunda tahkime başvurma nedenlerine değinilecek; bu alanın hukukçular için barındırdığı yenilikler gösterilip, bu kapsamda spor tahkiminin önde gelen kurumları güncel gelişmeler ışığında açıklanacaktır. Bu kapsamda öncelikle Spor Tahkim Mahkemesi (Court of Arbitration for Sport (CAS)), sonrasında ise Türkiye Futbol Federasyonu bünyesindeki Uyuşmazlık Çözüm Kurulu ile Tahkim Kurulu, ardından Spor Hukuk Genel Müdürlüğü Tahkim Kurulu ve son olarak FIBA Basketbol Tahkim Mahkemesi (Basketball Arbitral Tribunal (BAT)) incelenecektir. Spor tahkiminin adil yargılanma hakkıyla bağlantısını ortaya koyabilmek için konu, Avrupa İnsan Hakları Mahkemesi (AİHM) kararları ve Anayasa Mahkemesi (AYM) kararları çerçevesinde ele alınacaktır.
