| dc.description.abstract | Hukuk devleti, eylem ve işlemleri hukuka uygun olan, insan haklarına dayanan, bu hak ve özgürlükleri koruyup güçlendiren ve aynı zamanda hukuk kurallarıyla kendini bağlı sayan ve yargı denetimine açık olan bir devlet düzenini ifade etmektedir. Bu kapsamda söz konusu devlet düzeni çerçevesinde, yönetsel işleyiş bakımından idarenin de hukuka uygunluğunun ve düzenli biçimde faaliyet göstermesinin sağlanması gerekmektedir. Bu noktada idarenin hukuka uygunluğunun ve düzenli biçimde işleyişinin sağlanması amacıyla Devlet Denetleme Kurulu kurulmuş ve Anayasal temele kavuşturulmuştur. Hukuk devleti ilkesi, devletin hukuk kurallarıyla bağlı olmasını sağlamak anlamına geldiğinden; Türk idari teşkilatı içerisinde yer alan Devlet Denetleme Kurulunun bu amaca ne derece hizmet edebileceğinin anlaşılabilmesi için görev alanının tespit edilmesi, ardından söz konusu işlevlerinin idari teşkilat yapısına ve dolaylı olarak bireyler üzerinde etkilerinin neler olduğunun ortaya konulması gerekmektedir. Bu doğrultuda çalışmada öncelikle Devlet Denetleme Kurulunun pozitif temellerinin neler olduğu ortaya konulacak, daha sonra bu kuruluşun Türk idari teşkilatı içerisindeki yeri ve görev alanı tespit edilerek; icra ettiği fonksiyonların etkileri güncel gelişmeler ışığında irde-lenecektir. | |
| dc.description.abstract | Rule of law refers to a state system whose actions and operations are in accordance with the law, based on human rights, that protect and strengthen these rights and freedoms and at the same time consider themselves bound by the rules of law and are open to judicial review. In this context, it should be ensured that the administration complies with the law and operates in a regular manner in terms of managerial functioning within the framework of the state order. At this point, the State Supervisory Council was established and stipulated in the Constitution in order to ensure the proper functioning of the administration and the lawfulness of the administration. the principle of the rule of law means that the state is bound by the rules of law; In order to understand the extent to which the State Supervisory Council can serve this purpose within the Turkish administrative organization, it is necessary to determine the scope of its functions, and then to determine the effects of these functions on the administrative organization structure and indirectly on the individuals. In this context, firstly, the normative base of the State Supervisory Board will be determined and then the place and the scope of this organization within the Turkish administrative organization are determined. the effects of the functions it performs on the Turkish administrative structure will be examined in the light of current developments. | |
