Türk ticaret kanunu'nun 1427. maddesinin 3. fıkrası kapsamında sigortacıdan talep edilen avans ödemesinin hukuki niteliği

Article 1427 clause 3 of Turkish Commercial Code, Act No. 6102 sets out the principles regarding the insurer’s obligation to pay advances for compensation. In the relevant provision, the policyholder/insured, who cannot obtain compensation due to the delay in the investigations regarding the performance of the insurer, is entitled to demand advance payment from the insurer. In the justification of the provision, it is stated that the advance payment is aimed at eliminating the grievances of the policyholder/insured as soon as possible. However, there is no clarity regarding the terms of the right to demand advance payment from the insurer or the legal nature of the advance payment. Considering the importance of compensation for the policyholder/insured who has suffered due to the risk realized, the mentioned issuesregarding the advance payment, which servesto protect the interests of the policyholder/insured effectively and promptly, should be clarified.

6102 sayılı Türk Ticaret Kanunu m. 1427 f. 3’te sigortacının tazminat için avans ödeme yükümlülüğüne ilişkin esaslar düzenlenmektedir. İlgili hükümde, sigortacının edimine ilişkin araştırmaların gecikmesi sonucu tazminat alacağına kavuşamayan sigorta ettirene/sigortalıya, sigortacıdan avans talep etme hakkı tanınmaktadır. Hükmün gerekçesinde ise, avans ödemesiyle sigorta ettirenin/sigortalının mağduriyetinin bir an önce giderilmesinin amaçlandığı belirtilmektedir. Ancak sigortacıdan avans talep etme hakkının şartlarına veya avans ödemesinin hukuki niteliğine ilişkin bir açıklık bulunmamaktadır. Gerçekleşen riziko nedeniyle mağdur durumda bulunan sigorta ettiren/sigortalı için tazminat alacağının önemi gözetildiğinde, sigorta ettirenin/sigortalının menfaatinin etkin ve ivedilikle korunmasına yarayan avans ödemesine ilişkin söz konusu hususların netleştirilmesi gerekmektedir.
