| dc.description.abstract | Social media, nowadays a widely used platform, is significant due to the form of communication established among its users. Individuals who have succeeded in gathering large audiences within their follower base on social media have come to be known as social media influencers. Through their regular and consistent posts, social media influencers can alter the will of the interactees who fall within their sphere of influence. This communication between influencers and other social media users is a subject that requires examination from the perspective of whether a liability arises between the parties. Within the scope of this study, we have examined the types of liability that may arise specifically from social media influencers' posts, and the potential claims they may face as a result. The fundamental concepts of private law have been addressed, particularly from a civil law perspective, and the influencer's liability has been determined. It has been clarified whether a social media influencer enters into a contractual relationship with their followers, how a reliance liability (culpa in contrahendo) is formed towards them, and which of their posts constitute a tort. Each liability scenario has been analyzed in three separate sections, with the final section explaining the consequences of this liability. | |

Sosyal medya kapsamında genfş kftlelerf kendf takfp havuzunda toplamayı başaran kfşfler sosyal medya etkfleyfcfsf olarak anılmaya başlanmıştır. Sosyal medya etkfleyfcflerf düzenlf ve süreklf yapmış oldukları paylaşımlarla kendfsfnfn etkf alanına gfren etkfleşenlerfn fradelerfnf değfştfrebflmektedfr. Etkfleyfcflerfn dfğer sosyal medya kullanıcıları fle olan bu fletfşfmf, taraflar arasında bfr sorumluluk doğup doğmayacağı açısından fncelenmeye muhtaçtır. Çalışmamız bağlamında sosyal medya etkfleyfcflerfnfn özellfkle yapmış oldukları paylaşımlar dolayısıyla gündeme gelebflecek sorumluluk türlerf ve bu sorumluluk sonucunda karşılaşmaları muhtemel talepler fncelenmfştfr. Özel hukukun temel kavramları özellfkle medenf hukuk bakış açısıyla ele alınmış, etkfleyfcfnfn sorumluluğu tespft edflmfştfr. Sosyal medya etkfleyfcfsfnfn etkfleşenlerf fle bfr sözleşme flfşkfsfne gfrfp gfrmedfğf, onlara karşı güven sorumluluğunun nasıl oluştuğu ve haksız fffl teşkfl eden paylaşımlarının neler olduğu açıklanmıştır.
