| dc.description.abstract | Tezimiz temelde ticaret sicili müdürlüğüne yöneltilen tescil talebini ve akabinde gerçekleşen süreci konu almaktadır. Çalışmada özel olarak tescil halleri incelenmemiş tez başlığındaki sınırlama doğrultusunda tescilin genel esasları ele alınmıştır. Sicil müdürlüğünün talebe ilişkin verdiği karar ve karara karşı başvurulabilecek itiraz yolu ile de çalışma sonlandırılmıştır. Böylelikle tescilin gerçekleştirilmesinden sonraki süreç olan tescilin hukuki etkileri ve hatalı tescilden doğan sorumluluk bu yüksek lisans tezi kapsamına dahil edilmemiştir. Çalışma üç bölümden oluşmaktadır. Sicil müdürlüğünde gerçekleşen tescil prosedürünün anlaşılmasını sağlamak adına ilk bölüm, ticaret sicilinin genel olarak incelenmesine ayrılmıştır. İkinci bölümde talep ile başlayan tescil prosedürü ayrıntılı şekilde ele alınmıştır. Üçüncü bölümde ise tescil talebine yönelik incelemeler sonucu sicil müdürlüğünün vereceği karar ve bu karara karşı itiraz yolu incelemeye tabi tutulmuştur. Her bir bölümde tartışmalı hususlara ilişkin görüşümüz, çok sayıda Yargıtay kararı ve doktrindeki farklı görüşler ile birlikte sunulmuştur. | |
| dc.description.abstract | The registration request directed to the trade registry office and the subsequent process are discussed in our thesis. In the study, the cases of registration were not specifically examined, but the general principles of registration were discussed in accordance with the limitation in the title of the thesis. The study was completed with the decision made by the registry office regarding the request and the way to appeal against the decision. In this way, the legal effects of registration, which is the process after registration, and the liability arising from inaccurate registration are excluded from the scope of this master's thesis. The study consists of three chapters. In order to understand the registration procedure at the registry office, the first chapter is allocated to a general examination of the trade registry. In the second chapter, the registration procedure starting with the request, is discussed in detail. After discussing the registration procedure in the previous chapter, the third chapter examines the decision of the registry office as a result of the examination of the registration request and the way to appeal against this decision. In each chapter, our views on controversial issues are presented with the approach of the Court of Appeal and different views expressed in doctrine. | |
