dc.description.abstractHayatın her alanında dijitalleşme artarken, "bilgi toplumu" ekonomiden politikaya, sosyal hayattan bireysel haklara kadar her yerde gün geçtikçe hakimiyetini ve yaygınlığını artırmaktadır. Çevrimiçi yasa dışı faaliyetlere ilişkin endişeler, Avrupa’da ve küresel olarak, tüketici korumasının yanı sıra dijital platformlarda temel hakların ve kişisel hakların korunması açısından güvenli bir dijital ortam için belirli kural ve ilkeler oluşturma ihtiyacını doğurmuştur. Avrupa Birliği, yasa dışı içerik, şeffaf reklamcılık ve dezenformasyonla ilgili Avrupa Birliği'nin yasal çerçevesini güncellemek ve farklı ulusal yasaları uyumlaştırmak için Dijital Hizmetler Yasası'nı oluşturmuştur. Bu tez, kurumların ilgili yasal düzenleme konusunda nasıl karar verdiğini izlemeyi amaçlamaktadır- bu nedenle çalışmayı, müzakere masalarında önemli konuların ve tartışmaların ele alınmasıyla birlikte gerçek dünya sürecine yoğunlaştırmaktadır. Bu tez Dijital Hizmetler Yasasının içeriği veya etkileri gibi daha sık incelen bir konu yerine yasama sürecine odaklanarak literatüre katkı sağlamayı amaçlamaktadır. Çalışmada, Dijital Hizmetler Yasası’nın oluşturulması sırasında yaşanan yoğun tartışmaların yasanın önemini pekiştirdiği ve yasa hakkında önemli anlaşmazlıkların denge sorunlarıyla ilgili olması Dijital Hizmetler Yasası’nın genel kapsamı hakkında yaygın bir fikir birliği bulunduğunu göstermiştir
dc.description.abstractAs digitalization increases in every aspect of life “information society” is increasing its dominance and prevalence day by day everywhere from economy to politics, from social life to individual rights. Concerns regarding illegal activities online have led to the need to establish certain rules and principles for a safe digital environment in Europe and globally and in terms of consumer protection as well as the protection of fundamental rights and personal rights on digital platforms. The European Union created the Digital Services Act to update the European Union’s legal framework regarding illegal content, transparent advertising, disinformation and harmonizing different national laws. This thesis aims to trace the process of how the institutions decided on the relevant legal act - thus to concentrate the study on the real-world procedure by which also dealing with the substantial issues and controversies on the negotiating tables. This thesis seeks to add to the literature by being focused on the legislative process rather than more commonly studied aspects like the content of the Digital Services Act or its effects. The study finds that the extensive debate during the creation of the Digital Services Act reinforces its importance and that the significant disagreements being on questions of balance highlights that there was general agreement on the broad framework of the Digital Services Act
