With the idealization of transparency and accountability by the concepts of rule of law and democracy, state secrecy has tended to transform into an exceptional field However, the indispensability of some government activities to be confidential by their nature continues today These facts linked the justification of the state secret to its function in a democratic society State secret can be a mean or reason for interference to the fundamental rights and freedoms Freedom of expression is one of the prominent among these rights and freedoms Jurisprudence of the European Court of Human Rights (ECHR) are instructive in terms of the nature of state secret and how it can be harmonized with freedom of expression The study focused on how state secret was handled in limiting freedom of expression in the judgments of the ECHR It has been determined that the disclosure of state secrets is interpreted within the scope of freedom of expression in some cases These interpretations are based on the existence of public interest such as the society’s right to information, transparency, and democracy.
