Tacirin ücret ve faiz isteme hakkı

Ticari işletmesi ile ilgili iş veya hizmet gören tacirin ücret isteyebileceğini, yaptığı gider ve avanslar için de ödeme tarihinden itibaren faize hak kazanacağını vazeden Türk Ticaret Kanunu’nun 20. maddesi tacir olmaya bağlanan sayılı nimetten birini öngörmüştür. Çalışmamızın ilk bölümünde ücret ve faiz isteme haklarının ortak koşulları ele alınmıştır. İkinci bölümde ücret isteme hakkı detaylı olarak incelenmiş, ücret isteme hakkının ihtiva ettiği iki işlevin hukuki mahiyeti ve uygulama alanı tespit edilmiştir. Nihayet üçüncü bölümde faiz isteme hakkı mercek altına alınmış ve özellikle hakkın uygulama şartları açıklanmıştır.

Article 20 of the Turkish Commercial Code, which stipulates that a merchant may claim remuneration for services related to their commercial enterprise and may also demand interest for expenses and advances made, envisions one of the limited benefits conferred by the status of being a merchant. In the first part of our study, the common conditions for the rights to claim remuneration and interest are addressed. The second part provides a detailed examination of the right to claim remuneration, identifying the legal nature and scope of application of the two functions inherent in this right. Finally, in the third section, the right to claim interest is scrutinized, and an attempt is made to explain the conditions for its application.
