Türk ceza hukukunda terör örgütü ve terör suçu kavramları üzerine bir inceleme

Abstract

Son zamanlarda öğretide yoğun bir şekilde tartışılmakta olan terör örgütü kavramı, 3713 sayılı Terörle Mücadele Kanunu’nun 7. maddesinde tanımlanmaktadır. Buna göre cebir ve şiddet kullanılarak; baskı, korkutma, yıldırma, sindirme veya tehdit yöntemleriyle, terör tanımı başlıklı 1. maddede yer verilen amaçlara yönelik olarak suç işlemek üzere kurulan bir örgüt terör örgütüdür. Terör eylemlerinden hareketle terör örgütünü tarif eden kanun koyucu, aynı Kanun’da ayrıca mutlak ve nispi terör suçlarına yer vermektedir. Bu çerçevede terör örgütünün değerlendirilmesini amaçlayan çalışmamızda, bunun yanı sıra suç örgütü ve silahlı örgüt kavramları da incelenmektedir.

The concept of a terrorist organization, which is being discussed intensively in the doctrine recently, is defined in Article 7 of the Anti-Terror Law No. 3713. According to this, through use of force and violence, by means of coercion, intimidation, suppression or threat methods, any organization established to commit crimes for the aims specified under article 1, the definition of terror, is a terrorist organization. the legislator describing the terrorist organization on the basis of terrorism, has also included absolute and relative terrorist offenses in the same Law. In this context, in this study which aims to evaluate the terrorist organization, the concepts of criminal organization and armed organization are also examined.
