İnsan üzerinde deney suçu

Abstract

Birey, toplumun yapı taşıdır. Bireylerin hayatlarını huzur ve güven içinde devam ettirebilmeleri için hukuki olmayan müdahalelerden korunmaları gerekir. Bireylerin vücut bütünlüğü, ceza hukuku korumasını gerektiren önemli bir hukuki değerdir. Bu öneme istinaden 5237 sayılı Türk Ceza Kanunu’nun “Özel Hükümler” başlıklı ikinci kitabının “Kişilere Karşı Suçlar” başlıklı ikinci kısmının “Vücut Dokunulmazlığına Karşı Suçlar” başlıklı ikinci bölümünde bireylerin vücut bütünlükleri çeşitli suç tipleri ile koruma altına alınmıştır. Bu suçlardan biri de bu çalışmanın konusunu oluşturan ve TCK m. 90/1’de düzenlenen insan üzerinde deney suçudur. Bilimsel gelişmenin sağlanabilmesi için kişilerin deney yapmaları zorunluluktur. Ancak bu gelişme hiçbir hukuki sınırlamaya tabi olmaksızın gerçekleştirilemez. TCK m. 90/1’de düzenlenen insan üzerinde deney suçu bu sınırı ceza hukuku bakımından belirlemiştir. Bu çalışmada TCK m. 90/1’de düzenlenen insan üzerinde deney suçu, suç inceleme sistematiği çerçevesinde incelenmektedir.

The individual is the building stone of society. In order for individuals to continue their lives in peace and security, they must be protected from unlawful interventions. The physical integrity of individuals is an important legal value that requires criminal law protection. Based on this importance, physical integrity of individuals is protected with various crimes established under the second book titled “Special Provisions” in the chapter titled “Crimes against Physical Integrity” of the section titled “Crimes against Persons” within the Turkish Criminal Code No. 5237. One of these crimes is the crime of experiment on human beings, which is the subject of this study and regulated in Article 90 of the Turkish Criminal Code. In order to achieve scientific development, it is imperative that people do experiments. However, this development cannot be achieved without any legal restrictions. The crime of experiment on human beings regulated in Article 90 of the Turkish Criminal Code has drawn the line in terms of criminal law. In this study, the crime of experiment on human beings, which is regulated in Article 90 of the Turkish Criminal Code, is examined within the framework of the crime examination system.
