Bu durum uygulamada bazı sorunlara sebebiyet vermiştir. Bu sorunlardan biri de tacirin tüketici sayılıp sayılamayacağı ve eğer sayılacaksa hangi durumlarda tüketici olarak nitelendirileceği sorunudur. Zira bir yanda Türk Ticaret Kanunu’nda tanımlanan ticari iş ve ticari iş karinesi ile öbür tarafta Tüketicinin Korunması Hakkında Kanun’da bütün gerçek ve tüzel kişileri kapsayacak şekilde yapılan tüketici tanımı birbiriyle çelişen iki hüküm olarak karşımıza çıkmaktadır. This situation caused some problems in practice. One of these problems is whether the trader can be a consumer and if so, in what circumstances. Because, on the one hand, the presumption of commercial business and commercial business accepted in the Turkish Commercial Code and on the other hand, the definition of consumer made to cover all real and juristic persons in the Protection of the Consumer Law appear as two contradictory provisions.
