Kural ve ilkeleri birbirinden ayıran ve tartımı ilkelere özgü bir uygulama olarak gören ilkeler teorisi, Alexy’nin temel haklar teorisinin normatif temelleri açısından başlangıç noktasını oluşturur. Alexy; bu eserinde sadece anayasal hakların tanımı, yapısı ve çerçevesi ile ilgili analizlerde bulunmamakta aynı zamanda teorisinin temelini oluşturan ilkeler teorisinin de ana hatlarını çizmektedir. Bu çalışma, Alexy’nin anayasal haklar teorisinin bu temel argümanlarını mercek altına almakta ve özellikle ilkeler teorisinin temel kabullerini değerlendirmeyi amaçlamaktadır.“A Theory of Constitutional Rights”, which is one of the prominent works in German constitutional law, written by Robert Alexy, tries not only to determine the limits and scope of constitutional rights, but also to explain the definition and the normative structure of constitutional rights. Principle theory, which distinguishes rules and principles and declares balancing as the legal application of principles, serves as the starting point for the norm-theoretical foundation of Alexy’s theory of constitutional rights. In his work, Alexy not only analyses the definition, the structure and the scope of the constitutional rights, but also outlines the principle theory forming the basis of his constitutional rights theory.
