Abstract

İnsan onuru ve insan hakları cezaevinde olan kişiler için de geçerlidir. Cezaların infazı ve hükümlülerin iyileştirilmesine ilişkin düzenlemeler de buna dayanmalıdır. Temel olarak, koğuş ve hücre sistemi ile bu odaların genişliği ve eşyaları bu kapsamda değerlendirilmektedir. Ancak, cinsiyetlerin ayrılması, sigara içmeyenlerin korunması ve duş konularının da insan hakları bağlantısı bulunmaktadır. Almanya’da mahkemeler - Federal Anayasa Mahkemesi de dâhil olmak üzere - ve öğreti cezaevlerinin insan hakları yönleriyle ilgilenmektedir. Bu çalışmada, insan onuruna saygı vurgusuyla belirli sorunlar tartışılmaktadır.
